1. TERMS OF SERVICE

1. Agreement

Welcome to Hue & Go. These Terms of Service (“Terms”) govern your access to and use of hue-and-go.com (the “Site”) and any purchase made through it. The Site is operated by Urbinn Ecom LLC, a New Mexico limited liability company (“we,” “us,” or “our”).

By accessing the Site, browsing our products, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. Eligibility

You must be at least 18 years old, or the age of majority in your state, to place an order. By purchasing, you represent that you are an adult and that the payment information you provide is accurate, current, and lawfully yours to use. Although our products are designed for both kids and adults, only adults may complete purchases.

3. Products

We sell art supplies, including the Hue & Go watercolor palette. We make every reasonable effort to display product colors, finishes, and dimensions accurately, but actual products may vary slightly due to screen settings, photography, and small manufacturing variances. Pigment hues, in particular, can render differently across devices.

We reserve the right to modify, limit, or discontinue any product at any time without notice. We may also limit order quantities or refuse orders at our discretion (for example, for orders that appear placed by resellers or that violate these Terms).

4. Pricing and payment

All prices are listed in US dollars and exclude taxes and shipping unless stated otherwise. Applicable taxes are calculated at checkout based on your delivery address.

We accept the payment methods displayed at checkout. By submitting payment, you authorize us (and our payment processor) to charge the full order amount, including any taxes and shipping fees.

If a product is listed at an incorrect price due to a typographical error or technical issue, we reserve the right to cancel the order and refund any amount charged. We will notify you before doing so.

5. Orders and acceptance

Submitting an order is an offer to purchase. Your order is accepted only when we send a shipping confirmation email. Until then, we may decline or cancel any order, including for reasons of suspected fraud, payment failure, stock unavailability, or shipping address restrictions.

6. Shipping and returns

Shipping, delivery, returns, and refunds are governed by our Shipping Policy and Refund Policy, which are incorporated into these Terms by reference.

7. Intellectual property

All content on the Site — including the Hue & Go name, logo, product photography, copy, design, and the underlying code — is owned by Urbinn Ecom LLC or our licensors and is protected by US and international intellectual property laws.

You may not copy, reproduce, modify, distribute, or create derivative works from any part of the Site without our prior written consent. Personal, non-commercial browsing is permitted.

8. User content

If you submit reviews, photos, comments, or other content (“User Content”), you grant Urbinn Ecom LLC a worldwide, royalty-free, perpetual, non-exclusive license to use, reproduce, modify, and display that content in connection with our business, including marketing.

You represent that your User Content is yours to share, does not infringe anyone’s rights, and does not contain unlawful, defamatory, or offensive material. We may remove User Content at our discretion.

9. Prohibited use

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorized access to the Site, our servers, or other users’ accounts.
• Use bots, scrapers, or automated tools to access or extract data from the Site.
• Interfere with the Site’s operation or security.
• Resell our products without our written authorization.

10. Disclaimer of warranties

The Site and our products are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or harmful components.

11. Limitation of liability

To the maximum extent permitted by applicable law, Urbinn Ecom LLC, its members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or related to your use of the Site or our products.

Our total liability for any claim arising out of or relating to these Terms or your purchase will not exceed the amount you paid for the product giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Urbinn Ecom LLC and its members, officers, and employees from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your User Content, or your misuse of the Site or our products.

13. Governing law and dispute resolution

These Terms are governed by the laws of the State of New Mexico, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms or your purchase will be resolved in the state or federal courts located in Bernalillo County, New Mexico, and you consent to the personal jurisdiction of those courts.

Nothing in this section prevents you from bringing a small claims action in your local jurisdiction where eligible.

14. Changes to these Terms

We may update these Terms at any time. The updated version will be posted on this page with a new effective date. Continued use of the Site after changes are posted constitutes acceptance.
